Drunk driving penalties can be harsh — even for first time DWI offenders. However, with each offense of drunk driving, the resulting penalties become even more severe.

  • 1st offense DWI: Jail time (72 hours - 180 days); fines (up to $2000, with additional surcharges of $1000 each year for three years, and $2000 each year for three years if your BAC is double the legal limit); license suspension (90 days - 1 year)
  • 2nd offense DWI: Jail time (72 hours - 180 days); fines (up to $4000, with additional surcharges of $1500 each year for three years, and $2000 each year for three years if your BAC is double the legal limit); license suspension (30 days - 2 years)
  • 3rd offense DWI (Felony DWI): Jail time (2 - 10 years); fines (up to $10,000); license suspension (180 days - 2 years)

There are additional penalties if a minor was in the car, or if you are underage. Additionally, if you have a Commercial Driver's License (CDL), your license can be suspended if you are convicted of DWI.
